Terms of service
Welcome to Dirty Bastard. These Terms of Service (the "Terms") govern your use of getdirtybastard.com, our mobile experiences, our subscription service, and any related services offered by Dirty Bastard Laundry Company LLC ("Dirty Bastard", "we", "us", "our"). By using our website or placing an order, you agree to these Terms. If you do not agree, do not use the site or place an order.
These Terms include a binding arbitration clause and class action waiver in Section 14. Read carefully.
1. Who we are and how to reach us
Dirty Bastard Laundry Company LLC is a Florida limited liability company with a principal place of business in Tampa, Florida. For any question about these Terms or your order, contact us at hello@getdirtybastard.com.
2. Eligibility
You must be at least 18 years old to purchase from Dirty Bastard, subscribe to our service, or consent to marketing messages. By placing an order or creating an account, you represent that you meet this age requirement and that the information you provide is accurate.
3. Account registration
You may browse getdirtybastard.com without an account. To manage a subscription, view orders, or earn rewards, you may be asked to create an account. You are responsible for keeping your login credentials secure and for all activity under your account. Notify us at hello@getdirtybastard.com if you believe your account has been compromised.
4. Products and descriptions
We make reasonable efforts to describe and picture our products accurately. Colors, scents, and packaging may appear slightly different in person due to device settings, lighting, or batch variation. We reserve the right to limit quantities, correct errors in pricing or product descriptions, refuse service, and cancel orders at our discretion, including after an order has been placed. If we cancel an order for which you have already been charged, we will refund the charge.
5. Pricing, promotions, and discount codes
All prices are listed in US dollars and are exclusive of applicable sales tax. Tax is calculated at checkout based on your shipping address. Promotional codes, including howdy15, are subject to the following terms unless otherwise stated in writing:
- One use per customer.
- Cannot be combined or stacked with any other discount, promotion, or reward redemption.
- Applies to subtotal before tax and shipping.
- Not redeemable for cash.
- Expires on the date shown at the time the code is issued or within a reasonable window, whichever is earlier.
- We may cancel, modify, or end any promotion at any time.
6. Subscriptions and auto-renewal
Our subscription service (powered by our subscription provider) charges your payment method automatically on the schedule you select (every 4, 6, or 8 weeks). By enrolling in a subscription, you agree to recurring charges at the then-current subscription price until you cancel.
How to cancel or change your subscription. Sign in to your account at getdirtybastard.com, open your rewards or subscription dashboard, and use the Skip, Pause, Swap Scent, Change Frequency, or Cancel controls. You may also email hello@getdirtybastard.com at least two business days before your next scheduled shipment to request a change. Cancellation takes effect before your next renewal charge, and you will not be charged again after you cancel. You are responsible for any charge that has already processed before cancellation.
Shipping and fulfillment of subscription orders. Subscription orders ship free within the United States. The first subscription order ships on the date you select at checkout (or the next business day if you pick a weekend). Subsequent orders ship on the recurring schedule you selected.
Price changes. We may change subscription pricing. If we do, we will notify you by email at least 14 days before the change takes effect and give you an opportunity to cancel without penalty before the new price applies.
7. Payment
By providing a payment method, you authorize us and our payment processor to charge that payment method for the amounts due for your orders and recurring subscription charges, plus applicable tax. You represent that you are the authorized user of the payment method. If a charge is declined or reversed, we may suspend or cancel your order or subscription and may attempt to collect the amount due by other lawful means.
8. Shipping, delivery, and risk of loss
See our Shipping Policy at /policies/shipping-policy for full details. Title and risk of loss for physical products pass to you on delivery to the carrier. Delivery dates are estimates and not guarantees.
9. Returns and refunds
See our Refund Policy at /policies/refund-policy for full details. Because Dirty Bastard is a consumable personal-care product, we accept returns only on unopened, unused product in its original packaging within 30 days of delivery.
10. SMS and email marketing
If you opt in to SMS marketing by checking the consent box and providing your phone number, you agree to receive recurring automated marketing text messages from Dirty Bastard at the number you provide, including messages about new products, restocks, discounts, and subscription reminders. Consent is not a condition of any purchase. Message and data rates may apply. Message frequency varies, typically 2 to 8 messages per month. Reply HELP for help or STOP to unsubscribe at any time. Carriers are not liable for delayed or undelivered messages. For full details see our Privacy Policy at /policies/privacy-policy.
If you opt in to email marketing, you agree to receive marketing and transactional emails. You may unsubscribe from marketing emails at any time using the link in any marketing email.
11. Reward program
Our loyalty program rewards active subscribers. Reward cycles are counted based on fulfilled subscription shipments only. Canceled subscriptions forfeit unclaimed cycles and any reward progress. Claimed rewards are subject to availability of size and stock. We reserve the right to modify or end the program at any time. Reward merchandise has no cash value. Limit one reward of each tier per customer unless we say otherwise in writing.
12. User conduct and acceptable use
You agree not to:
- Use the site for any unlawful purpose or in violation of these Terms.
- Interfere with the operation, security, or integrity of the site or our infrastructure.
- Scrape, data-mine, or otherwise harvest content except as permitted by our robots.txt.
- Resell our products without our prior written consent.
- Impersonate any person or submit false or misleading information.
- Place orders with the intent to defraud, including using stolen payment methods or triangulating returns.
We may suspend or terminate access, cancel orders, cancel subscriptions, and pursue other remedies against users who violate this Section.
13. Intellectual property
The site, the Dirty Bastard name, the logo, the product packaging, the copy on the site, and the original photography and design are owned by Dirty Bastard Laundry Company LLC or our licensors and are protected by United States and international intellectual property laws. You may view and print content for personal, non-commercial use. Any other use requires our prior written permission.
User-generated content (reviews, social posts, survey responses). When you submit a review, post, photo, or other content about Dirty Bastard through the site, social media tags, or a direct submission, you grant us a non-exclusive, worldwide, royalty-free, sublicensable, perpetual license to use, reproduce, adapt, and display that content in our marketing, on our site, and in our packaging, with attribution by first name and last initial and city.
14. Arbitration, class action waiver, governing law
Arbitration. Except for disputes that qualify for small claims court or injunctive relief, any dispute between you and Dirty Bastard arising out of or relating to these Terms, your use of the site, your purchase, or your subscription will be resolved exclusively by final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will take place in Tampa, Florida, or by video or phone at the arbitrator's discretion. Judgment on the award may be entered in any court of competent jurisdiction. Each party will bear its own costs except as provided by the AAA rules.
Class action waiver. You and Dirty Bastard each agree that disputes will be resolved on an individual basis only. Neither you nor we may bring a claim as a class action, collective action, or representative action. The arbitrator may not consolidate claims or preside over any form of representative proceeding.
Governing law. These Terms are governed by the laws of the State of Florida, without regard to conflict of laws principles. Any dispute not subject to arbitration (such as small claims or injunctive relief) will be filed exclusively in the state or federal courts located in Hillsborough County, Florida, and you consent to personal jurisdiction and venue in those courts.
Opt out of arbitration. You may opt out of this arbitration agreement by emailing us at hello@getdirtybastard.com within 30 days of first placing an order, with the subject line "Arbitration Opt-Out" and including your full name, order number, and a clear statement that you wish to opt out. Opting out does not affect any other term of these Terms.
15. Disclaimers
THE SITE AND THE PRODUCTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
Before using any laundry detergent product, including Dirty Bastard, read the label and follow usage instructions. If you have a known allergy or sensitivity to any ingredient listed on the packaging, do not use the product.
16. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, DIRTY BASTARD, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE OR THE PRODUCTS. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE PRODUCTS WILL NOT EXCEED THE AMOUNT YOU PAID DIRTY BASTARD IN THE SIX MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF CERTAIN DAMAGES, SO SOME OF THE LIMITATIONS IN THIS SECTION MAY NOT APPLY TO YOU.
17. Indemnification
You agree to indemnify and hold harmless Dirty Bastard, its officers, directors, employees, and affiliates from any claim, demand, loss, liability, damage, cost, or expense (including reasonable attorney's fees) arising out of or relating to your breach of these Terms, your misuse of the site, or your violation of any applicable law or third-party right.
18. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will post the updated Terms on the site and update the "Last Updated" date. Your continued use of the site after changes take effect constitutes acceptance of the updated Terms. For changes to the subscription auto-renewal terms, we will provide at least 14 days email notice as described in Section 6.
19. Miscellaneous
These Terms are the entire agreement between you and Dirty Bastard about your use of the site and the products. If any provision is held unenforceable, the rest of the Terms remain in effect. Our failure to enforce any right or provision is not a waiver. These Terms are personal to you. You may not assign them without our written consent. We may assign these Terms at any time.
